Special Education Law
THE BEST TIME TO PLAN IS NOW
Special Education Law
I represent parents of children with special needs who are seeking special education and related services for their children through the school system. Children with special needs are entitled to a Free and Appropriate Education in the least restrictive environment.
My services cover a broad range of topics and can be tailored to your needs. I can represent you directly in meetings with the school system; or I can work with you “behind the scenes” so that when you approach your school district, you are aware of your rights as a parent and your child’s rights. Don’t let the school system intimidate you, or take advantage of you or your child.
Typical Areas of Consultation are:
- The School System’s obligation to identify children who may need services
- How to start the qualification process for special education and related services?
- Does my child have the type of disability that would qualify for services?
- How to obtain an evaluation for your child and who pays for it?
- What is my recourse if my child is denied services?
- What is an IEP?
- What is a 504 Plan?
- What related services might my child be eligible for?
- As a parent, can I request an IEP Meeting, and who can, and should be present?
- Legal requirements for what should happen in an IEP Meeting, and afterwards.
- Advice about Placement
- What rights do I have if my school fails to implement my child’s IEP?
- My child is graduating from high school, will the IEP be honored in college?
- Do you have a special needs child that has been bullied? Has the school system failed to do anything about this?
Combatting Discrimination Against Special Needs Children
Additionally, if you feel that your special needs child was discriminated against in any way through the school system, there are laws which address this serious issue. I can advise you what to do if you feel this has occurred. Some examples of discrimination against special needs children may include:
- Being excluded from a field trip;
- Being excluded from clubs, sports or extra-curricular activities;
- Being placed in an environment that is inferior to that of non-disabled students
BE PROACTIVE. THERE ARE LAWS TO PROTECT YOUR CHILD.
Fees: I try to work by a Flat Fee whenever possible. Occasionally, an hourly rate will apply. There are instances in which attorney’s fees may be paid for by the school system.
